Jones, Wolf & Kapasi, LLC ("JWK") was granted final approval of a consumer class action settlement in the United States District Court for the District of New Jersey alleging that M.L. Zager, P.C., a debt collection law firm, violated 15 U.S.C. 1692, et seq, the Fair Debt Collection Practices Act ("FDCPA") by sending debt collection letters to Plaintiff and the class which falsely represented or implied: it was a communication from an attorney, that the law firm was even retained to file a lawsuit against Plaintiff or the putative class, and that any attorney from the law firm was meaningfully involved in the debt collection process.
The parties' settlement included the maximum statutory amount to Plaintiff under the FDCPA, monetary relief to the class as well as that the law firm agreed to pay JWK's reasonable attorneys' fees. In addition, JWK partner, Joseph K. Jones, was appointed class counsel.
