Jones, Wolf & Kapasi, LLC Obtains Final Approval of New Jersey FDCPA Class Settlement Related to Initial Debt Collection Letter Failing to Notify Consumers That Balance Was Subject to Increase

Jones, Wolf & Kapasi, LLC (“JWK”) argued and obtained from the United States District Court For the District of New Jersey an Order granting final approval of a class action settlement in a 15 U.S.C. 1692 et seq, the Fair Debt Collection Practices Act (“FDCPA”) case against Fein, Such, Kahn & Shepard, P.C. (“Fein Such”).

The FDCPA case involved Fein Such’s attempt to collect on a judgment where interest, costs and/or fees were still accruing on the judgment but the initial debt collection letter failed to advise that the balance was subject to increase.

The class action settlement includes monetary relief to the named Plaintiff, the 566 New Jersey class members, as well as attorney fees and costs. JWK attorneys Joseph K. Jones and Benjamin J. Wolf were certified as Class Counsel. In addition, the National Consumer Law Center (“NCLC”) was approved as the cy pres recipient.
