Jones, Wolf & Kapasi, LLC Obtains Final Approval of New Jersey FDCPA Class Settlement Related to Debt Collection Letter Sent to an Estate by Greenspoon Marder, LLP

Jones, Wolf & Kapasi, LLC (“JWK”) argued and obtained from the United States District Court For the District of New Jersey an Order granting final approval of a class action settlement in a 15 U.S.C. 1692 et seq, the Fair Debt Collection Practices Act (“FDCPA”) case against a national law firm, Greenspoon Marder, LLP.

JWK previously defeated a motion to dismiss wherein the Court found that Plaintiff sufficiently pleaded Greenspoon Marder sent a debt collection letter which: (1) was wrongly addressed to a decedent’s estate instead of the executor, (2) included misleading language that indicates the reader could be responsible for the date instead of the decedent’s estate, and (3) included other confusing language that conflicts with Plaintiff’s validation notice rights under the FDCPA.

The class action settlement includes monetary relief to the named Plaintiff, the 62 New Jersey class members, as well as attorney fees and costs. JWK attorneys Joseph K. Jones and Benjamin J. Wolf were certified as Class Counsel. In addition, the National Consumer Law Center (“NCLC”) was approved as the cy pres recipient.
