Jones, Wolf & Kapasi, LLC Granted Final Approval of FDCPA Class Settlement Related to NJ Student Loan Debt Collected by Russell P. Goldman, PC

Jones, Wolf & Kapasi, LLC ("JWK") argued and obtained from the United States District Court for the District of New Jersey an Order granting final approval of a class action settlement in two 15 U.S.C. 1692 et seq, the Fair Debt Collection Practices Act (“FDCPA”) cases against a New Jersey debt collection law firm, Russell P. Goldman, PC ("RPG"), and its attorney, Russell P. Goldman, Esq.

Plaintiffs' claims were premised on RPG sending consumers a misleading and deceptive debt collection letter attempting to collect a New Jersey student loan debt along with "collection costs". Plaintiffs argued that these "collection costs" were, in reality, RPG's contingency fee with the State of New Jersey, and had not been incurred by RPG at the time it sent the debt collection letters to Plaintiffs.

The class action settlement includes monetary relief to the named Plaintiffs, the 185 New Jersey class members, as well as attorney fees and costs. JWK attorney Joseph K. Jones was certified as Class Counsel.

The cases are Kenny D. Mancheno v Russell P. Goldman, PC, and Russell P. Goldman, 3:19-cv-06646 (ZNQ)(D. N.J.) and Edward M. DiPetrillo, Jr. v Russell P. Goldman, PC, and Russell P. Goldman, 3:19-cv-10554 (ZNQ)(D.N.J.) and the Final Approval Order can be read here.

This is the second class action against RPG that JWK has settled. The prior one was entitled:  Brian P. Carney and William C. Gumpper, Jr. v Russell P. Goldman, PC, 3:15-260 (BRM)(DEA) and the Final Approval Order can be read here.
