Jones, Wolf & Kapasi, LLC Obtains Final Approval of New Jersey FDCPA Class Settlement Related to Debt Collection Law Firm Ragan & Ragan, P.C. Sending Information Subpoenas and “Notice of Waiver of Rights”

Jones, Wolf & Kapasi, LLC (“JWK”) argued and obtained from the United States District Court for the District of New Jersey an Order granting final approval of a class action settlement in a 15 U.S.C. 1692 et seq, the Fair Debt Collection Practices Act (“FDCPA”) case against Ragan & Ragan, P.C. (“R&R”), a debt collection law firm.

The FDCPA case involved R&R sending New Jersey consumers letters or notices that included Information Subpoenas and “Notice of Waiver of Rights” which our client alleged violated the FDCPA and New Jersey state law.

The class action settlement includes monetary relief to the named Plaintiff, the over 1,000 New Jersey class members, as well as attorney fees and costs. JWK attorneys Joseph K. Jones and Benjamin J. Wolf were certified as Class Counsel. In addition, the National Consumer Law Center (“NCLC”) was approved as the cy pres recipient.

The case is Stefano Rubino v Ragan & Ragan, P.C., Civil Action No. 2:21-cv-20288 (D. New Jersey February 14, 2023) and the Final Approval Order can be read here.
