Jones, Wolf & Kapasi, LLC Obtains Judgment For Over $45,000 Against NJ Home Improvement Contractor For Breaching Settlement Agreement

Jones, Wolf & Kapasi, LLC ("JWK") argued and obtained from the Supreme Court of the State of New York, New York County, an Order awarding our clients over $45,000 from a New Jersey home improvement contracting company, and its owner, individually (collectively “the contractor”).

Our clients’ claims were premised on the home improvement contractor violating New York’s General Business Law (“GBL”) §770 et seq., related to home improvement work at their Manhattan apartment. After the contractor defaulted in responding to our clients’ Complaint, the parties entered into settlement negotiations which resulted in a signed settlement agreement. The contractor breached the terms of the settlement agreement, and the Court granted JWK’s motion to enforce the settlement in its entirety.
JWK attorneys Joseph K. Jones and Benjamin J. Wolf were the attorneys of record.

The case is Almoradie et al. v Michael B. Samiel d/b/a Michael Samiel Home Improvement et al., Index No. 656730/2020 (Sup. Ct. NY County November 22, 2021), and the Court’s Decision and Order can be read here.
