Jones, Wolf & Kapasi, LLC ("JWK") argued and obtained from the United States District Court for the District of New Jersey an Order granting final approval of a class action settlement in a 15 U.S.C. 1692 et seq, the Fair Debt Collection Practices Act (“FDCPA”) case alleging that Portfolio Recovery Associates, LLC (“PRA”), a debt collector, sent a letter to over 400 New Jersey consumers attempting to collect a debt, which was time-barred by the applicable statute of limitations.
The class action settlement includes monetary relief to the named Plaintiff, the New Jersey class members, as well as attorney fees and costs. JWK attorney Joseph K. Jones was certified as Class Counsel.
The case is Michael O’Brien v Portfolio Recovery Associates, LLC, 2:16-cv-04634 (D. New Jersey). The Final Approval Order can be read here.
