Jones, Wolf & Kapasi, LLC ("JWK") was granted class certification on behalf of 9,177 New Jersey consumers while defeating Defendant, Green Tree Servicing, LLC's ("Green Tree") motion for summary judgment in its entirety. Plaintiff, Carol Grubb, claims that Green Tree sent debt collection letters to her, and 9,177 New Jersey consumers, related to their residential mortgages, which violated 15 U.S.C 1692 et seq, the Fair Debt Collection Practices Act ("FDCPA"); specifically, Sections 1692g and 1692e of the FDCPA.
At the close of discovery, after over three and half years of litigation, Ms. Grubb moved for class certification and Green Tree moved for summary judgment. In a 50 page Opinion, the Court denied the summary judgment motion as to Green Tree's arguments that it was not a "debt collector", and that it did not violate the FDCPA. In the same Opinion, not only did the Court grant class certification on behalf of 9,177 New Jersey consumers but it also certified Plaintiff as the class representative as well as that JWK attorneys Joseph K. Jones, and Benjamin J. Wolf, are class counsel.
