Jones, Wolf & Kapasi, LLC Granted Final Approval of New Jersey FDCPA Class Settlement Related to Improper Communications By California Debt Collectors

           Jones, Wolf & Kapasi, LLC ("JWK") argued and obtained from the United States District Court for the District of New Jersey an Order granting final approval of a class action settlement in a 15 U.S.C. 1692 et seq, the Fair Debt Collection Practices Act (“FDCPA”) case against several California debt collection companies including a law firm, and its managing attorney.

          Plaintiff’s FDCPA case was premised on several communications sent to her directly when the debt collectors knew she was represented by an attorney, which included misleading language that made her unsure and confused as to her statutory time to dispute the debt, falsely represented meaningfully attorney involvement by the California debt collection law firms and/or that they could commence litigation as they were unlicensed to practice law in New Jersey.

          The class action settlement includes monetary relief to the named Plaintiff, the over 50 New Jersey class members, as well as attorney fees and costs. JWK attorney Joseph K. Jones was certified as Class Counsel.
